These Terms & Conditions (“Terms”) govern your access to and use of the website at www.cherrehpic.com (the “Site”), owned and operated by Etch Media and Apparel (“Company,” “we,” “us,” or “our”), and any purchases, accounts, or services offered through the Site. By accessing the Site or purchasing from us, you agree to these Terms. If you do not agree, do not use the Site.

2) Eligibility & Accounts
You must be at least the age of majority in your state/country (or have parental permission) to use the Site.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
We may suspend or terminate accounts that violate these Terms or applicable law.
3) Orders, Pricing & Availability
All orders are offers to purchase products. We may accept or reject any order for any reason, including suspected fraud, inventory limits (e.g., limited drops), or errors.
Prices, promotions, and product details may change without notice. We use commercially reasonable efforts for accuracy but errors may occur; in that case, we may cancel or correct the order before shipping and will notify you.
Displayed colors and textures can vary by device and screen; slight variations are not defects.
4) Payment & Taxes
We accept the payment methods shown at checkout. By submitting a payment, you authorize us (and our payment processors) to charge your method for the total amount (including shipping, taxes, and any applicable duties).
You are responsible for all taxes, duties, and import fees not collected at checkout.
5) Shipping, Risk of Loss & Delivery
Shipping options, costs, and estimated timelines are shown at checkout and/or in our Shipping Policy (if posted). Estimates are not guarantees.
Title and risk of loss transfer to you upon our delivery of goods to the carrier.
We are not liable for delays outside our control (e.g., carrier delays, customs, weather). We’ll work in good faith to help you track or resolve issues.
6) Returns, Exchanges & Cancellations
Returns and exchanges are subject to our Return/Exchange Policy (if posted on the Site). If no separate policy is posted, the following applies:
Return window: 14 days from delivery for unworn, unwashed, unaltered items with original tags/packaging.
Final sale: Limited-edition drops, discounted items, custom items, gift cards, and accessories marked “final sale” are not returnable.
Process: Contact us at etchmediaandapparel@gmail.com with your order number before sending anything back. Unauthorized returns may be refused.
Condition: Items returned with signs of wear, damage, odors, or missing components may be rejected or incur a restocking fee.
Refunds: Issued to the original payment method (less shipping) once inspected and approved. Shipping costs are non-refundable unless required by law.
Cancellations are not guaranteed once an order is placed; contact us immediately and we’ll do our best.

7) Promotions, Gift Cards & Store Credit
Promotions and discount codes are subject to their own terms and may not be combined or applied retroactively.
Gift cards/store credit are not redeemable for cash (except where required by law) and cannot be replaced if lost or stolen. Treat them like cash.
8) Intellectual Property
The Site, all content (including designs, logos, graphics, text, photos, videos), and the Cherreh Pic brand are owned or licensed by Etch Media and Apparel and protected by copyright, trademark, and other laws.
You may not copy, reproduce, modify, distribute, display, or create derivative works from the Site or its content without our prior written consent.
All trademarks, service marks, and trade dress—whether registered or not—are our property or the property of their respective owners.
9) User Content & Feedback
If you submit reviews, photos, designs, comments, or other content (“User Content”), you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, host, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media for our business purposes.
You represent that you own or control all rights in your User Content and that it does not infringe any third-party rights or violate any law.
We may remove or refuse any User Content at our discretion.
10) Acceptable Use
You agree not to:
Use the Site for any unlawful purpose or to solicit others to perform unlawful acts.
Interfere with or circumvent security features or attempt to access non-public areas.
Scrape, crawl, or use automated means without our written permission.
Upload malicious code, spam, or content that is defamatory, obscene, harassing, or infringing.
11) Third-Party Services & Links
The Site may link to third-party sites or use third-party tools (e.g., payment processors, analytics). We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
12) Disclaimer of Warranties
To the fullest extent permitted by law, the Site and all products and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.
13) Limitation of Liability
To the fullest extent permitted by law, Etch Media and Apparel and its officers, directors, employees, agents, affiliates, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages; or for lost profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of the Site or purchase of products, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim in the 12 months preceding the event.
14) Indemnification
You agree to defend, indemnify, and hold harmless Etch Media and Apparel and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your: (a) use of the Site; (b) violation of these Terms; (c) User Content; or (d) violation of any law or third-party right.
15) Copyright/Trademark Concerns
If you believe content on the Site infringes your rights, contact us at etchmediaandapparel@gmail.com with: (1) identification of the work you claim is infringed; (2) identification of the material you claim is infringing; (3) your contact info; (4) a statement of good-faith belief; and (5) a statement that the information is accurate and you are authorized to act. We may remove content at our discretion.
16) Privacy
Your use of the Site is also governed by our Privacy Policy (separate document). If a Privacy Policy is not yet posted, we still collect and process personal data as necessary to fulfill orders, provide the Site, and comply with law. 17) Governing Law; Dispute Resolution
Governing Law: These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules.
Venue: Subject to the arbitration clause below, the state and federal courts located in San Francisco County, California shall have exclusive jurisdiction. You consent to such jurisdiction and venue.
Arbitration (Optional—but recommended for clarity): Except for small-claims matters or claims for injunctive relief, any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by JAMS under its Rules. The seat of arbitration will be San Francisco, California. The arbitrator may award individual relief only; no class or representative actions are permitted.

18) International Users
If you access the Site from outside the United States, you are responsible for compliance with local laws and any import, export, or customs rules applicable to purchases.
19) Changes to the Site or Terms

20) Severability & Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver.
21) Entire Agreement
These Terms, together with any policies posted on the Site (e.g., Privacy Policy, Shipping, Returns), constitute the entire agreement between you and us regarding the Site and supersede prior or contemporaneous understandings.
